Can your employer place you on unpaid leave (Nov 19, 2021) – stand4thee.com

Describes the difference between ‘unpaid leave’ and ‘constructive dismissal’, and recommends what should do in response if you don’t plan on providing proof of vaccination. Download pages 3-4.

Here’s an excerpt: So, what do you do when you have been told by your employer they have placed you on unpaid leave? You go to work as per your regular schedule, you did not agree to the unpaid leave. If you work outside of your home, show up for work and attempt to access the building. If you work remotely, then try to login. Record yourself trying to access your place of work. If you are accessing a building and told to leave, then leave. It’s not necessary to escalate, you simply want to create a record of your attempting to go to work. Then email your boss and state what happened; how you were blocked and by whom, etc. In that same message, state that you do not consent to being placed on unpaid leave.

What this does is protect you as later down the road if you do not push back, it could be claimed that you agreed to the leave. And could set you up as though you resigned by not reporting to work. Don’t give this opportunity!

Take the jab or lose the job – Justice with John Carpay from Justice Centre for Constitutional Freedoms (JCCF)(Sept 13, 2021) – 56 min. podcast: John reports that the Justice Centre is being inundated with calls from around the country of people who are facing the prospect of being forced to take a Covid shot or being terminated. He gives Canadians some good advice on what to do if you find yourself in that situation.

In the FAQ, you’ll find this advice from JCCF:

My employer says take the vaccine or lose my job, what do I do?

  1. If you take the vaccine, you will not have a legal claim against your employer, and it is unlikely that you can sue your employer for any damage caused by the vaccine. In order to have a cause of action (legal claim) against your employer, you need to refuse the vaccine and accept the consequences, including termination of employment. You will need to hire a lawyer to sue your employer for wrongful dismissal, if your employer terminates your employment for not taking the vaccine.
  2. Before doing anything else, use this template prepared by the Justice Centre legal team, that can be modified to suit your circumstances in response to an employer or educational institute demanding a mandatory vaccine. You can send this to your employer now, without needing to hire a lawyer. Keep your employer’s response(s) and provide that to the lawyer you retain. This recent lawsuit launched by Rocco Galati and Police on Guard for Thee against mandatory workplace vaccinations (August 25, 2021) contains some valuable information on what you should keep in mind in case of any future legal action you may need to take. These are the criteria Galati is requiring of the plaintiffs:

  • You must not be vaccinated against Covid-19
  • Do not resign from your job
  • Do not partake in PCR testing, or any other testing that may be implemented in the future, to the best of your ability.
  • You must not have presented your employer with an exemption letter.

And it goes without saying, document all communication (audio/video) and correspondence with your employer!

Canadian Constitution Supremacy Clause – Section 52(1)

52.(1) The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.

If one examines all of the documents it becomes clear that the Yukon government declared state of emergency is not appropriate and the respective measures, including the ministerial order for mandatory masking, travel restrictions as well as 14 day solitary confinement punishment if you do travel are all unconstitutional and the suspension of our rights and freedoms has not been properly executed nor is it justifiable under any current circumstance. We are being lied to and indoctrinated with propaganda on a daily basis, fearmongering being at the core of it along with unscientific claims that cannot be substantiated or proven being used to justify draconian measures causing immeasurable harm.

The corrupt government politicians are using strongarm bully tactics and censorship to further the globalist agenda of destroying our rights, freedoms, way of life, economy and society while imposing more totalitarian control.
